Critical Enterprise Status Is Not Enough

Ukraine allows critically important enterprises to reserve eligible employees from mobilization, but this mechanism does not automatically apply to every employee.

The government has recently tightened the rules governing reservation quotas and the criteria used to determine whether an enterprise remains critical. From June 2, 2026, businesses have also faced new requirements concerning employee salaries, multiple employment and reservation quotas.

For students, however, there is an additional issue: their military-registration category.

Simply being employed by a company that has critical status does not necessarily mean a student can be included in its reservation list.

The Important Difference Between Conscripts and Those Liable for Service

Students can fall into different categories in Ukraine’s military register.

If a student is registered as a conscript, they are not included in the general number of persons liable for military service used to calculate the employer’s reservation quota.

If the student is registered as a person liable for military service, however, they can potentially be included in that calculation and may be eligible for reservation if the other requirements are met.

This distinction can be particularly confusing because people under the age of 25 can belong to either category.

Why Age Alone Does Not Determine the Status

It would be easy to assume that anyone under 25 is automatically treated as a conscript.

The current system is more complicated.

This is why employers are being advised to check the actual military-registration category of employees rather than relying solely on their age.

New Reservation Rules Are Coming in September

The issue is becoming more important as Ukraine approaches another major change to the reservation system.

The government has introduced a transition period during which critically important enterprises must confirm that they continue to meet the updated criteria. Existing critical status is not automatically cancelled, but enterprises must go through the new confirmation process within the established deadlines.

From September 1, new rules will also affect the calculation of the number of employees who can be considered for reservation.

For example, a person who already has a deferment on another legal basis may be treated differently when calculating an enterprise’s quota.

Students Can Have a Deferment for Another Reason

Another important point is that student status itself may provide a legal basis for deferment in certain circumstances.

That is different from military reservation by an employer.

Reservation is connected to employment at an eligible enterprise and the employer’s quota. A student deferment, meanwhile, arises from the person’s status as a student if the statutory requirements are satisfied.

This distinction means that a student may not necessarily need employer-based reservation to have protection from mobilization.

Employers Face New Responsibilities

The changes also create additional work for companies.

Employers with critical status need to review their employee lists, check military-registration information and ensure that people included in reservation applications actually qualify.

The government has also introduced a salary requirement for reservation at ordinary critical enterprises. From June 2026, the relevant threshold is three minimum monthly salaries, or UAH 25,941, with a lower threshold of 2.5 minimum salaries for enterprises in frontline territories.

This means that even when an employee is formally eligible for reservation, the employer must still satisfy the applicable requirements.

What Students Should Check

Students who work at critically important enterprises should not assume that their employer’s status automatically protects them.

The most important things to check are:

  • their military-registration category;
  • whether they have another legal basis for deferment;
  • whether the employer remains officially classified as critically important;
  • whether they are included in the employer’s reservation quota;
  • and whether their military-registration information is current.

The distinction is increasingly important as Ukraine moves toward the new reservation rules scheduled to take effect on September 1.
